Scalemint Private Limited ("ProMark", "Company", "us", "we", or "our") operates a performance marketing service for D2C brands. This Privacy Policy ("Policy") explains what information we collect when you visit our website and/or use our services available on or through https://thepromark.com/ and related pages, including our growth assessment and lead forms (collectively the "Platform"), and how we use, store, and share that information.

By using the Platform or submitting your information to us (including through our website forms, WhatsApp, or Meta/Instagram Lead Ads), you agree to the collection and use of your information as described in this Policy.

This Policy applies to:

  1. Visitors who fill out our brand assessment/lead forms (on our website or via Meta/Instagram Instant Forms);
  2. Prospective and existing clients who engage ProMark for marketing services;
  3. End customers of our clients, whose data we may access while managing advertising campaigns, pixels, and ad accounts on our clients' behalf; and
  4. General visitors to our website.

1. Information We Collect

a. Information you provide directly:

  • Full name, brand/business name, website URL
  • WhatsApp number and/or phone number
  • Email address (where requested)
  • Business details you share with us — such as monthly revenue range, current advertising spend, delivery/RTO challenges, and other information shared during onboarding calls or via voice notes on WhatsApp

b. Information collected automatically:

  • IP address, browser type, device information, and referral URL
  • Pages visited and time spent on our website
  • Cookies and similar tracking technologies (see Section 3)

c. Information from advertising platforms:

  • If you submit a Meta or Instagram Lead Ad form, we receive the information you provide in that form (as permitted by Meta's platform terms)
  • Ad account and pixel-level data from client ad accounts we manage (aggregate/performance data, not individual end-customer identities, unless required for campaign optimisation)

2. How We Use Your Information

We use the information we collect to:

a. Assess whether your brand is a fit for our services; b. Contact you (via WhatsApp, phone, or email) regarding your enquiry or our services; c. Provide, manage, and optimise advertising campaigns for clients who engage us; d. Analyse website and campaign performance to improve our services; e. Send you relevant updates about our services, unless you opt out; f. Comply with applicable legal obligations.

By submitting your details, you consent to being contacted on the WhatsApp number/phone number provided, including for promotional purposes, even if you are registered on the National Customer Preference Register (NCPR).

3. Cookies and Tracking

Our website uses cookies and similar technologies (including the Meta Pixel and Google Analytics) to understand website traffic, measure ad performance, and improve user experience. You can disable cookies through your browser settings, though some parts of the website may not function as intended if you do so.

4. How We Share Your Information

We do not sell your personal information. We may share it:

  • With third-party tools we use to operate our business (e.g., CRM tools, WhatsApp Business API providers, scheduling tools, analytics providers) — solely to the extent needed to provide our services;

We retain your information only for as long as necessary to fulfil the purposes described in this Policy, or as required by law. If you ask us to delete your information and there is no ongoing legal or contractual reason to retain it, we will do so within a reasonable time.

  • Ask us to update, correct, or delete your personal information;
  • Opt out of promotional communications by messaging us on WhatsApp or emailing us (contact below);

Our services are directed at business owners and are not intended for individuals under the age of 18. We do not knowingly collect personal information from children.
